New years bring hope, resolutions, and often law changes. The California Consumer Privacy Act (CCPA) took effect today in the Golden State and will surely be a closely watched precedent for the rest of the nation. The law is modeled in part after similar legislation in Europe.

A Summary of What You Need to Know
The CCPA is a data privacy law that grants California residents new rights regarding the collection, sharing, and use of their personal information. Within this, residents have the right to
- Access and request the deletion of their personal information &
- Have the right to request that their personal information not be sold.
In order to comply with this new right, companies that “sell” personal information must have a “Do Not Sell My Personal Information” link on their websites.
Understand the Terms
“Personal information” is a broad term, but may include information that is shared with third parties to serve interest-based advertising. Companies who do business in California, regardless of where they themselves are located, must comply with the law if they exceed one of the thresholds specified in the CCPA, primarily involving revenue, personal data collection, and the “sale” of personal data.
